1. Provider and scope

Kumilo is offered contractually to adults with legal capacity who are parents, guardians or otherwise legally responsible for the child. Children use Kumilo only through a profile managed by such an adult and do not enter into a separate contract with Kumilo.

These terms apply to the website, app, parent account, child profiles, support and learning features that are actually enabled. Purchases through Apple App Store or Google Play are also subject to the store and payment terms identified in checkout; mandatory consumer rights remain unaffected.

2. Age range, countries and authority

Kumilo is designed for parent-managed child profiles from ages 4 to 16. The managing adult confirms that they may lawfully set up the account and profiles, provide the required permissions and supervise the child's use.

Within the intended age range, the service is not currently blocked automatically because of the country of access or a particular age band. The parent-account and permission process is not a government age or identity check. The managing adult is responsible for using Kumilo only in accordance with the local requirements that apply to them. Kumilo may adjust safeguards, features or availability where a legal or technical assessment requires it.

3. Account, preview and child profiles

Some static examples may be viewed without a connected parent account. Real AI questions, cloud synchronisation, purchases and other protected features are enabled only after the intended parent-account, sign-in and permission flow. Children need neither an email address nor an independent login.

The managing adult selects the nickname, age level, language and feature permissions, protects the parent area and keeps information current. A profile may be created only for a child for whom that person has the required responsibility or permission.

4. Service and artificial-intelligence disclosure

Kumilo is an AI-assisted learning companion. Questions, stories, pictures, voice and follow-up suggestions may be created, edited or checked by artificial intelligence. The app identifies that role in the use context. Kumi is a digital character, not a human being.

Despite safeguards, AI output may be incomplete, inaccurate, invented or unsuitable. Kumilo does not replace teachers or professional medical, psychological, legal, educational, financial or emergency advice. Adults must verify important information using reliable sources and contact local emergency services where necessary.

5. Responsibility of the managing adult

The managing adult chooses features at an age-appropriate level, supervises use, explains the limits of AI and decides whether a result suits the particular child. The selected age level controls presentation; it is not a medical, educational or developmental assessment.

Parental permissions apply only to the named profiles, purposes and policy versions. Withdrawing a required permission ends the corresponding network, synchronisation, camera or voice function for future use.

6. Acceptable use and private information

Inputs may be used only where their processing is lawful. Prohibited uses include unlawful, exploitative, violent or sexual content; personal documents or credentials; bypassing safeguards; automated bulk traffic; security attacks; identity deception; infringement of copyright, trade mark, personality or privacy rights; and using Kumilo to monitor, score or deliberately manipulate a child.

Kumilo is not designed for full names, addresses, contact details, documents, health records, intimate information, passwords or other secrets. Filters help detect risk but do not replace the managing adult's responsibility not to enter that information.

7. Rights in inputs and results

Rights in a person's own input remain with the person entitled to them. For the duration and scope of the requested feature, the managing adult grants Kumilo a non-exclusive right to technically copy, transmit, adapt and have that input processed by contracted providers. The right is limited to service delivery, safety, troubleshooting and the purposes in the privacy notice.

To the extent permitted by law, the family may use generated results privately. AI output may be similar or identical for other users and carries no promise of exclusive rights. Kumilo does not guarantee that an output is free of third-party rights. Kumilo's brands, app code, design, editorial content and Kumi character remain protected. Kumilo may use non-confidential feedback without payment to improve the product.

8. Features, changes and availability

Kumilo may provide typed questions, photo explanations, discoveries, stories, image generation, voice, synchronisation and other learning features. The exact scope depends on device, operating system, language, age level, country, store version, parental permission, provider status and, where applicable, plan.

Server-generated images are not a permanent archive. Even where an image is referenced by a cloud-synchronised family chat, the current independent R2 storage rule may remove it after approximately 35 days; the rest of the chat may remain without that image.

Maintenance, safety, capacity, law or an external-provider outage may temporarily limit features. Kumilo may reasonably improve, replace or discontinue a feature while taking the contract's purpose and users' legitimate interests into account. Continuous or error-free availability is not promised.

9. Prices, store purchases, renewal and cancellation

The website does not currently sell subscriptions. If a paid in-app product is enabled, the provider or merchant, scope, total price, billing period, duration, auto-renewal, cancellation, device and store requirements and statutory withdrawal and conformity rights will be shown before ordering. A purchase is made only through the store's clear confirmation step.

Purchases are managed in the Apple App Store or Google Play account used. Cancellation and any refund are also subject to the merchant identified there and mandatory store and consumer rules. Deleting a Kumilo account or the app does not cancel a store subscription; it must be cancelled in the store in time. These terms do not limit mandatory withdrawal, refund or remedy rights.

10. Account security

The managing adult must protect their Google, Apple or email sign-in, device access and parent PIN, never share one-time codes and promptly report suspected misuse. Accounts and store entitlements may not be sold, transferred or shared outside the family.

11. Safeguards, suspension and termination

Kumilo may reject content, limit a feature, revoke sessions or temporarily suspend an account where a concrete security risk, serious or repeated breach, payment fraud, legal duty or protection of a child requires it. Where appropriate, Kumilo will explain the reason and available remedy; it may act first where there is immediate risk.

The managing adult can report a specific AI output for safety review. The reported output and the limited identifier and review metadata described in the privacy notice are normally stored for 90 days. Deleting only the child profile does not immediately end that retention; deleting the family account removes the report.

The managing adult may withdraw permissions, delete profiles and terminate the family account. Terms concerning rights, liability, billing, disputes and permitted residual retention continue where their purpose requires it.

12. Deletion and its effects

Account deletion removes server-side family and profile data through the process described in the privacy notice. Encrypted local content on other devices, rolling backups, pseudonymous store evidence and technically necessary deletion markers may remain for the stated periods. Deletion cannot be reversed.

13. Statutory conformity rights and liability

Statutory rights concerning defective digital products and other mandatory consumer rights remain in effect. Kumilo has unlimited liability for intent and gross negligence, injury to life, body or health, a guarantee it has assumed and mandatory liability such as product-liability law.

For a slightly negligent breach of an essential contractual duty, liability is limited to foreseeable loss typical of the contract. A duty is essential where its fulfilment enables proper performance and a user may normally rely on it. Liability for other slight negligence is excluded to the extent permitted by law. These limits also apply to representatives and agents.

14. Governing law, complaints and dispute resolution

German law applies. For consumers, this choice does not remove the protection of mandatory rules in the country of their habitual residence. Jurisdiction is determined solely under mandatory applicable law.

Complaints should first be sent to the contact address. Whether the operator participates in consumer arbitration or is required to do so is stated in the public provider information where section 36 of the German Consumer Dispute Resolution Act applies. The former EU Online Dispute Resolution platform has closed and is therefore not linked.

15. Changes and contact

Kumilo may change these terms for an objective reason, including new features, providers, safety needs or changes in law. Material changes will be notified appropriately before taking effect; renewed express agreement will be requested where required. Use the contact details on this website for questions.
